Terms and Conditions of Polimio.com

§1. Subject Matter

These Terms and Conditions (hereinafter: "Terms") define the conditions for providing services electronically via the educational platform Polimio.com (hereinafter: "Service"), the rights and obligations of registered users (hereinafter: "User") and the rights and obligations of the Service owner, i.e., Polimio.com spółka z ograniczoną odpowiedzialnością (limited liability company) with its registered office at Pl. Solny 14/3, 50-062 Wrocław, Poland (hereinafter: "Service Provider").

§2. Definitions

Account
an individual User profile created in the Service.
Demo Account
a User account providing free, limited access to courses.
Course
a set of language lessons available in the Service.
Price List
current prices of services/plans (including subscriptions, trial periods, promotions) as displayed in the Service's purchase panel.
Order
a statement of intent made by the User to purchase paid access to the Service (e.g. a subscription or one-time prepayment), submitted through the purchase panel.
Purchase Panel
the part of the Service where the User reviews the offer, pricing, selects a plan/service, and places an Order (e.g. by clicking "order and pay" or an equivalent button).
Subscription
paid access renewed cyclically in billing periods specified in the Price List.
Trial Period
the time during which the User tests full access to the Service under promotional conditions specified in the Price List.
Digital Content / Digital Services
content or services delivered electronically (e.g. access to courses, lessons, Service features) without a physical medium.
Registration
the procedure for creating an Account, consisting of filling out a form or logging in using a social media portal.
End Device
a computer, smartphone, tablet, or other device with Internet access.
GDPR
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.

§3. Polimio.com Service

  1. The Service is a work protected by copyright law. All copyrights belong to the Service Provider or authorized licensors.
  2. The Service is available in desktop and mobile versions. Some features may be limited depending on the device and browser.
  3. The Service Provider provides the following services electronically, in particular:
    • maintaining the User Account and enabling login,
    • access to Service features within the Demo Account (free of charge),
    • paid access to courses/lessons and premium features (e.g. as part of a Subscription or one-time prepayment – according to the Price List),
    • payment processing and billing (with the participation of external payment operators),
    • service contact and support.
Technical Requirements (conditions for providing services electronically):
  • An End Device with Internet access,
  • a current web browser (e.g. Chrome/Firefox/Safari/Edge) with JavaScript and cookies enabled,
  • an active User email address,
  • recommended: up-to-date antivirus software and operating system with security updates.
The User may not provide unlawful content or use the Service in a way that disrupts its operation or violates the rights of third parties.

§4. Copyrights

Materials posted on the Service (texts, graphics, audio, video, content layout) are the intellectual property of the Service Provider or licensors and may not be copied, distributed, or modified without the written consent of the Service Provider, subject to fair use as provided by applicable law.

§5. Registration and Account

  1. Creating an Account is free and requires providing a valid email address, which serves as the login.
  2. The User can also register using a social media portal.
  3. Only one person can use a single Account.
  4. The User is responsible for the confidentiality of their password and the security of access to their Account.
  5. The User may terminate the agreement for the provision of electronic services regarding the Account (delete the Account) at any time by contacting support@polimio.com or using the account deletion feature (if available in the Account panel). Deleting the Account may result in loss of access to content associated with the Account.

§6. Access to the Service

  1. A registered User receives a Demo Account.
  2. Full access is obtained after making a payment according to the Price List or promotional conditions.
  3. After the paid period expires, the Account automatically reverts to demo mode if it is not extended or the Subscription is not active.

§6a. Service Delivery Conditions / Delivery of Digital Content

  1. "Delivery" of the service means providing the User with paid access to premium features/digital content on their Account.
  2. As a rule, access is activated automatically upon confirmation of payment by the payment operator, no later than 1 business day from the payment confirmation.
  3. If the payment requires additional verification or processing (e.g. traditional bank transfer, if available), activation occurs no later than 2 business days from the receipt of funds.
  4. In case of technical issues, the User may report the problem in accordance with §10.

§7. User's Rights and Obligations

  1. The User is obliged to use the Service in accordance with the law, these Terms, and good practices.
  2. It is prohibited to:
    • use account names that violate the rights of third parties or are commonly considered offensive,
    • provide unlawful content,
    • destabilize the operation of the Service,
    • attempt to gain unauthorized access to the Service's resources.

§8. Service Provider's Rights and Obligations

  1. The Service Provider may refuse registration or block an Account if the User violates these Terms.
  2. The Service Provider sends to the User's email only information related to the Service, and marketing content – only after obtaining consent (where required).
  3. The Service Provider makes every effort to ensure the Service operates correctly, but may introduce technical breaks (e.g. maintenance, updates).

§9. Payments

  1. Prices are given gross (including VAT) and expressed in the currency displayed in the purchase panel.
  2. Payments are processed by external payment operators (including Stripe and PayU), using encrypted connections (SSL/TLS). The Service Provider does not store full payment card numbers.
  3. Available payment methods include, in particular, payments via Stripe and PayU (e.g. bank transfer, credit/debit card) – according to the methods currently made available by the payment operators during the payment process.
  4. Access to a Course can be purchased as a Subscription or a one-time prepayment – according to the Price List.
  5. The User can cancel the Subscription at any time from the account panel. Cancellation stops renewals for subsequent billing periods; access continues until the end of the paid period, unless the Price List/promotional conditions provide otherwise.
  6. The Trial Period (if available) lasts and is priced according to the Price List. The User may cancel the Subscription before the end of the Trial Period to avoid being charged for the next billing period.

§10. Complaints and Reporting Irregularities

  1. Irregularities in the functioning of the Service and complaints can be reported:

  2. Recommended complaint elements: full name, email address associated with the Account, description of the issue, date of occurrence, expected resolution.
  3. Complaints are processed within 14 days of receipt, with the possibility of extension by another 14 days in justified cases (the Service Provider will inform the User accordingly).

§11. Withdrawal from the Contract (Refund Policy)

  1. The Consumer may withdraw from the distance contract within 14 days of its conclusion (purchase), without giving any reason, subject to exceptions provided by law.
  2. The withdrawal statement may be submitted:

  3. The refund is made no later than 14 days from receiving the withdrawal statement, through the same payment channel (unless the User expressly agrees to a different arrangement).
  4. Note regarding digital content/services: if the User requests the commencement of service provision/delivery of digital content before the withdrawal period expires and acknowledges the loss of the right of withdrawal in cases provided by law, the right of withdrawal may not apply to the extent of the service already provided.
  5. In the case of vouchers purchased from partners, the refund is processed by the voucher seller.

§12. Personal Data Protection and Cookies

  1. The Service Provider is the administrator of personal data (details in §14).
  2. Data may be processed for the following purposes, in particular: (a) creating and maintaining an Account, (b) fulfilling an Order and providing access to services, (c) payment processing and billing, (d) complaint handling and communication, (e) fulfilling legal obligations (e.g. accounting/tax), (f) pursuing or defending legal claims.
  3. The legal basis for processing may include, depending on the purpose: performance of a contract (Art. 6(1)(b) GDPR), legal obligation (Art. 6(1)(c) GDPR), legitimate interest (Art. 6(1)(f) GDPR), and for marketing – consent (Art. 6(1)(a) GDPR), where required.
  4. Data recipients may include entities supporting the Service Provider (e.g. hosting, IT providers, email services), as well as payment service providers in the scope necessary for payment processing.
  5. Data is retained for the period necessary to achieve the purposes indicated above, and subsequently for the period required by law (e.g. tax regulations) or until the statute of limitations for claims expires.
  6. The User has the right to access their data, rectify it, delete it, restrict its processing, transfer it, object to its processing, and lodge a complaint with the competent supervisory authority.
  7. Requests regarding personal data can be submitted to: support@polimio.com.
  8. The Service uses cookies necessary for its proper operation. The User can block them in their browser, which may, however, prevent the use of the Service.

§13. Changes to the Terms

The Service Provider may change these Terms with 14 days' notice. Information about the change is published on the Service and sent to Users' email addresses. Using the Service after the changes come into effect means acceptance of the new Terms.

§14. Final Provisions

  1. These Terms are made available free of charge in a form that allows them to be downloaded, saved, and printed.
  2. The governing law for services provided by the Service Provider is Polish law. Disputes will be settled by the competent common court.
